This is an English translation provided for convenience. The binding version is the Russian original published at svetlanadorogaya.com/oferta.html. If the two texts differ, the Russian version prevails.
This document is an official proposal (public offer) by the psychologist Svetlana Dorogaya (the Provider or the Psychologist) to conclude a contract for psychological counselling services on the terms set out below with any adult individual with full legal capacity (the Client).
Taking any of the actions listed in section 3 constitutes full and unconditional acceptance of the terms of this offer and concludes a contract between the Provider and the Client (the Contract). Please read this document carefully before booking and paying. If you do not agree with any of its terms, do not accept it.
1. Terms and definitions
- 1.1Offer: this document, published on the Provider's website svetlanadorogaya.com and in the Telegram channel @dorogaya_svetlana.
- 1.2Acceptance: full and unconditional acceptance of the terms of the Offer by the actions listed in section 3.
- 1.3Services: psychological counselling using cognitive behavioural therapy (CBT), including individual sessions and assessment with questionnaires.
- 1.4Session (consultation): one online meeting between the Psychologist and the Client by video call, of the length set out in section 4.
- 1.5Booking: agreeing the date and time of a session through the website, Telegram or another agreed channel.
- 1.6Platform: the video call service used to hold a session.
- 1.7Website: the Provider's website svetlanadorogaya.com.
2. Subject of the contract
- 2.1The Provider delivers the Services to the Client online, and the Client accepts and pays for them in the manner and on the terms set out in the Offer.
- 2.2The Services are delivered personally by the Psychologist using CBT: exploring the request, assessment, teaching techniques, tasks between sessions, and support in changing thinking and behaviour.
- 2.3The Services are not medical care, psychiatric treatment or addiction treatment, and do not include diagnosis or prescribing medication. The Psychologist is not a medical doctor.
- 2.4The specific scope, extent and timing of the Services are agreed with the Client at booking.
3. Acceptance of the offer and conclusion of the contract
- 3.1Any of the following actions constitutes Acceptance of the Offer: paying for the Services in full or in part; agreeing the date and time of the first session after reading the Offer; sending a request through the form on the Website with the box confirming agreement to the terms ticked.
- 3.2By accepting, the Client confirms that they are at least 18 years old and have full legal capacity, that they have read the Offer, including the rules on rescheduling, cancellation and refunds (section 6), and that they accept them in full.
- 3.3The Contract is concluded electronically, without signing a paper copy, and is legally binding. The parties do not sign certificates of services rendered.
- 3.4The Client confirms that the information they provide about their health, medication and any medical supervision is accurate, and undertakes to report any changes to it.
4. How the services are delivered
- 4.1Booking is made through the form on the Website or by direct message on Telegram @Svetlana_Dorogaya. The Psychologist confirms the date and time personally. Session times are given in the Client's time zone; the Psychologist works in the Abu Dhabi time zone (UTC+4).
- 4.2Before the first session the Client completes an initial assessment: fills in questionnaires and clarifies their request.
- 4.3Sessions are held by video call on a platform agreed with the Client at booking. The Client is responsible for providing a device, a stable internet connection and a place where they will not be disturbed.
- 4.4One session lasts 60 minutes. Session time is counted from the agreed start time.
- 4.5If the Client is late, the session is not extended. If the Client does not join within 15 minutes of the start time and has not warned that they will be late, the session is treated as missed (a no-show) and is charged in accordance with section 6.
- 4.6If the Psychologist is late, the session is extended by the time lost or, by agreement with the Client, the time is made up at the next session.
- 4.7If a session cannot continue because of technical problems on the Psychologist's side, it is rescheduled at no extra charge. If the connection is lost for reasons on the Client's side and cannot be restored within 15 minutes, the session is treated as held, and the remaining time may be rescheduled at the Psychologist's discretion.
- 4.8Tasks between sessions (a thought record, self-observation, behavioural experiments) are part of the method. Completing them is up to the Client, but it affects the results of the work.
- 4.9Messaging between sessions is limited to practical matters (booking, rescheduling, payment) and brief questions about tasks. The messenger is not a channel for emergency help. What to do in an acute state is set out in clause 8.3.
5. Fees and payment
- 5.1The fee for the Services is set individually and given to the Client at booking. The agreed fee is recorded in the parties' correspondence.
- 5.2The Services are paid for in full in advance, no later than 24 hours before the start of the session, unless otherwise agreed with the Psychologist.
- 5.3Payment methods are given to the Client at booking.
- 5.4The Provider may change the fee for the Services. The fee for sessions already paid for does not change.
- 5.5After receiving payment, the Provider sends the Client a receipt generated in the Moy Nalog (My Tax) app.
6. Rescheduling, cancellation, no-shows and refunds
- 6.1The Client may reschedule or cancel a session free of charge by notifying the Psychologist no later than 24 hours before the agreed start time.
- 6.2If a session is cancelled or rescheduled later than that, or in the case of a no-show, the session is treated as delivered and is charged at 100 percent of the fee. This is because the time was reserved for the Client and cannot be offered to anyone else.
- 6.3In exceptional circumstances (illness, emergencies) the Psychologist may, at their discretion, reschedule a session without charging for it.
- 6.4If the Psychologist cancels a session, the Client is offered a new time or a full refund for that session, at the Client's choice.
- 6.5Either party may stop the work at any time. If a session is cancelled within the period set out in clause 6.1 and not held, the prepayment is, at the Client's choice, moved to a new session or refunded in full within 10 working days of receiving the request. If the Psychologist ends a session on the grounds set out in clause 7.2, the session is treated as delivered and the payment is not refunded. If the Psychologist stops the work for reasons unrelated to any breach by the Client, payment for sessions not held is refunded to the Client in full within the same period.
- 6.6A Service is deemed to have been properly delivered if the Client does not send the Psychologist a reasoned complaint within 24 hours of the session.
7. Rights and obligations of the parties
- 7.1The Psychologist undertakes: to deliver the Services personally, in good faith and in line with the principles of professional ethics and the CBT approach; to keep confidentiality in accordance with section 9; to explain the methods used in plain language; to tell the Client about the limits of their competence and recommend seeing a doctor where necessary; to give advance notice of any rescheduling.
- 7.2The Psychologist may: refuse to deliver the Services or stop the work if the Client is under the influence of alcohol or drugs, behaves aggressively, or breaches the payment terms, and also if the Client's request is outside the Psychologist's competence or requires medical care; discuss the progress of the work in professional supervision and peer consultation without disclosing anything that would identify the Client; change the terms of the Offer in accordance with section 11.
- 7.3The Client undertakes: to provide accurate information about themselves, their condition, medication and any medical supervision; to keep to agreed session times and the rescheduling rules; to pay for the Services on time; not to make audio or video recordings of sessions without the Psychologist's written consent; not to take part in a session while intoxicated; to treat the Psychologist with respect.
- 7.4The Client may: stop the work at any time; ask questions about the method and the progress of the work; decline to discuss particular topics; reschedule sessions on the terms of section 6.
8. Limitations and liability
- 8.1The Services are intended for people who do not need urgent medical or psychiatric care. The Services do not replace a consultation with a doctor. Where symptoms are pronounced, the Psychologist recommends seeing a doctor; CBT work may continue alongside treatment prescribed by a doctor.
- 8.2The Psychologist does not guarantee any particular result. Results depend on the Client's individual circumstances, the regularity of sessions and the completion of tasks between them. The stories on the Website illustrate the approach and are not a promise of results.
- 8.3The Services are not emergency help. If the Client believes they may harm themselves or others, they should contact the emergency services in their country or a doctor immediately.
- 8.4The Psychologist is not liable for decisions the Client makes on the basis of the consultations, or for the consequences of applying information received outside sessions.
- 8.5The Provider's liability under the Contract is limited to the fee paid by the Client for the session to which the claim relates.
- 8.6The Client is responsible for the accuracy of the information they provide, for the technical arrangements on their side, and for keeping confidential the materials they receive in the course of the work.
- 8.7The parties are released from liability for failure to perform their obligations caused by force majeure (natural disasters, communication and power failures, acts of the authorities and other circumstances beyond the parties' reasonable control). In that case sessions are rescheduled.
9. Confidentiality
- 9.1All information the Client shares with the Psychologist in the course of the work, including the fact that they have sought help, is confidential and is not passed on to third parties.
- 9.2Exceptions to confidentiality: a real threat to the life or health of the Client or of others; a requirement of the law or of an authorised body; discussion of the work in supervision and peer consultation without anything that would identify the Client.
- 9.3The Psychologist does not confirm to third parties that they work with the Client, and does not discuss the content of sessions with the Client's relatives or acquaintances without the Client's written consent.
- 9.4Anonymised stories from practice may be published only with details changed so that the person cannot be identified, and with the Client's consent. Testimonials are published only at the Client's initiative and in a form agreed with them.
- 9.5The Client understands that messaging and video calls take place through third-party services (messengers, video call platforms), whose security is determined by their operators.
10. Intellectual property and copyright
- 10.1All materials provided to the Client in the course of the work (worksheets, questionnaires, diagrams, methodological materials and handouts, recordings and presentations), as well as the content of the Website and the Telegram channel (texts, illustrations, diagrams, photographs, audio and video), are protected by copyright and belong to the Provider or other rights holders.
- 10.2The Client may use the materials received for personal, non-commercial purposes only. Copying, distributing, publishing, adapting or passing the materials on to third parties without the Provider's written consent is prohibited.
- 10.3Either party may make audio or video recordings of sessions only with the other party's prior written consent. The Psychologist does not record sessions without the Client's consent.
- 10.4Materials from the Website and the channel may be quoted to the extent justified by the purpose of quotation, with the author named and an active link to the source.
- 10.5The Client may not use the Psychologist's trademarks, name or image for advertising or other public purposes without written consent.
11. Term, amendment and termination of the contract
- 11.1The Offer is valid from the date of its publication on the Website until it is withdrawn by the Provider.
- 11.2The Provider may change the terms of the Offer unilaterally. Changes take effect from the moment a new edition is published on the Website. Services paid for before the changes were published are governed by the edition in force at the time of payment.
- 11.3The Contract remains in force until the parties have fully performed their obligations. Either party may terminate the Contract at any time by notifying the other; settlements are then made in accordance with section 6.
- 11.4The Provider may stop delivering the Services if the Client breaches the terms of the Offer or if help cannot be given within the Provider's competence, in which case the Provider informs the Client and, where appropriate, recommends another specialist.
12. Dispute resolution and governing law
- 12.1The parties seek to resolve all disagreements through negotiation. Complaints are sent in writing via Telegram @Svetlana_Dorogaya. The response time for a complaint is 14 days from receipt.
- 12.2Relations between the parties, including the conclusion, performance and termination of the Contract and the resolution of disputes, are governed by the laws of the Russian Federation.
- 12.3Electronic correspondence between the parties on Telegram and other agreed channels is legally binding.
- 12.4If any provision of the Offer is found to be invalid, the remaining provisions remain in force.
